What To Know About Filing a Personal Injury Lawsuit in Wyoming
You want compensation for your injuries, but where to begin? Below, we explain all you need to know about Wyoming’s filing deadlines and negligence rules. You’ll also learn where and how to file a claim.
If you’d rather not file your own claim, reach out to an attorney who’s a member of the Wyoming State Bar.
Filing Time Limits in Wyoming
Wyoming is one of the few states that gives you four years from the date of injury to file a claim (Title 1, Chapter 3, § 1-3-105). Most other states give you just two or three years to do so. You can’t recover damages if you don’t file your claim within four years.
This statute of limitations applies to many types of personal injury cases, including:
- Car accidents
- Dog bites
- Premises liability
- Product liability
For wrongful death claims, the deadline to file is just two years. Medical malpractice also has a two-year deadline. You may file either two years from the date of the malpractice or within two years of discovering your injury.
If someone intentionally injured you, you only have one year to file a claim. The following are some common examples of intentional torts:
- Assault and battery
- False imprisonment
- Malicious prosecution
- Defamation
If the Wyoming government is responsible for your accident, you must file a notice to sue within two years of your injury. You must then file a complaint in court within one year of filing the notice to sue.
The general statute of limitations pauses if the defendant goes into hiding or flees the state, preventing you from serving them with a notice to sue. The clock also pauses for mentally incapacitated and minor victims. It starts ticking again when the victim turns 18, or the mental incapacity is resolved.
Wyoming’s Comparative Negligence Rule
Suppose you had a car accident because you rolled through a stop sign while looking at your phone. Can you still recover damages?
Possibly. Wyoming follows a comparative negligence rule, which says you can recover damages as long as you’re 50% or less at fault. For example, if you’re 10% at fault, you can recover 90% of your damages. However, you can’t collect compensation if you’re 60% responsible.
Caps on Damages in Wyoming
Wyoming is unusual because it’s one of the few states that doesn’t cap personal injury damages. That means your compensation for economic and non-economic damages is theoretically unlimited.
How To File Your Claim
The court where you’ll file your complaint depends on the damages you’re requesting. You can file in small claims court if your damages are $6,000 or less. If they’re more than that but less than $50,000, you’ll file in a Wyoming circuit court. For damages of more than $50,000, you must file in a district court.
Regardless of the court, you’ll have to file a complaint. The complaint must include the following information:
- The names of everyone involved in your case
- Your injuries
- How, when, and where the accident happened
- What the defendant did to cause your injuries
- Your desired remedy (usually monetary compensation)
Filing a complaint is not free. For small claims, the fee is $10. Civil complaints cost $160 to file.

Frequently Asked Questions
Here, we’ve answered a few commonly asked questions about personal injury in Wyoming.
Do You Have To Serve the Defendant Yourself in Wyoming?
You don’t have to serve the defendant yourself if you don’t want to. Most plaintiffs have a professional process server handle the task on their behalf. The fee for this is $50.
Is Wyoming an At-Fault State?
Wyoming is indeed an at-fault state, meaning anyone who causes a car accident is liable for the other driver’s medical bills. In Wyoming, all drivers must have at least $25,000 in bodily injury coverage and $20,000 in property damage coverage per accident.
What Happens When You Miss the Filing Deadline?
If you miss the filing deadline, Wyoming courts will refuse to hear your case. Your Wyoming personal injury lawyer will file all required paperwork well before the deadline to ensure this doesn’t happen.
