Do You Need an Arkansas Accident Lawyer?
You might wonder whether you need an attorney for your personal injury case. While it is possible to file a lawsuit yourself, you stand a much better chance of prevailing with legal counsel on your side, especially when you’re up against a big insurance company.
You should consider hiring an Arkansas personal injury lawyer if:
- You want to maximize your compensation. Plaintiffs who have an attorney typically win a higher settlement than those who don’t.
- You don’t understand Arkansas laws and how they apply to your case. An attorney who is a member of the Arkansas Bar Association can explain confusing legal concepts to you in plain English.
- Your case involves a lot of damages. Your lawyer will calculate all your damages and ask for a fair settlement from the insurance company.
- You think the insurance company is acting in bad faith. This includes ignoring your phone calls, refusing to pay a valid claim, and leaving no room for negotiation.
- Your case involves a wrongful death. In Arkansas, only the deceased’s personal representative can make a wrongful death claim. If you are the personal representative, we can guide you through the claim process.

What You Need To Know About Filing a Personal Injury Lawsuit in Arkansas
Learn everything you should know about filing your personal injury lawsuit in Arkansas here.
Filing Deadlines
For most personal injury cases in Arkansas, you have three years from the date of the accident to file a claim (Arkansas Code Annotated § 16-56-105). This deadline also applies to product liability and wrongful death claims.
For medical malpractice cases, you have two years from the date of injury to file a lawsuit. The deadline can be longer if the victim was a minor or if the malpractice involved a foreign object left in your body that you couldn’t reasonably discover within two years.
You have one year to make a claim if you were hurt by intentional misconduct.
There are a couple of exceptions to the general statute of limitations. If the victim was a minor, they have three years after their 21st birthday to make a claim. If the defendant leaves Arkansas, the statute of limitations begins when they return.
Arkansas Comparative Negligence Rules
Can you still collect compensation if you’re partially at fault for the accident? Maybe. Arkansas allows you to recover damages as long as you’re less than 50% at fault. You’re out of luck if you’re more than 50% at fault.
How To File a Claim
To start the lawsuit process, you must file in the circuit court closest to where the defendant lives or where your accident happened. The filing fee for civil cases is $165.
You can file in small claims court if your damages are less than $5,000. Filing fees range from $30 to $60 (varies by jurisdiction).
Regardless of where you make your claim, you’ll have to file an official complaint. This document must include:
- The names of everyone involved in the claim
- When, where, and how the incident happened
- A description of your injuries
- Why you believe the defendant is legally responsible for your injuries
- The remedy you want

We Handle All Types of Arkansas Personal Injury Cases
From animal attacks to slip-and-fall cases, our attorneys handle it all. Learn more about some of the cases we can assist with below.
Premises Liability
Property owners are responsible for protecting guests from slips, trips, and falls. If a property owner knew about a hazard, such as a wet floor, and didn’t correct it, they’re liable if that hazard causes an accident.
Dog Bites
Even if a dog seems friendly and lovable, it can turn on you without warning. If you were attacked by someone’s loose dog while exploring Arkansas’ vast public lands, you can hold the owner liable.
Auto Accidents
Arkansas has much less traffic than densely populated states like New York, but that doesn’t mean car accidents are uncommon. Our firm handles all types of vehicle accidents, including car, bus, truck, bicycle, and motorcycle accidents. We also assist with Uber and Lyft collisions.
Construction Accidents
Despite stringent safety regulations, construction injuries are extremely common. Construction accidents can include falls from height, crush injuries, trench collapses, electrocutions, and toxic fume inhalation.
